You must be 18 years or older to use the Site for purposes of submitting personal information or scheduling appointments. By using the Site, you represent that you meet this requirement.

The Site is an informational and scheduling resource. Information published on the Site is for educational purposes only, is not medical advice, and does not create a clinician-patient relationship between you and Eki Mental Health PLLC or any provider. See the Medical Disclaimer.
3. Acceptable use
You agree not to:
- Scrape, crawl, or otherwise extract data without written permission;
- Impersonate another person or use another person's information;
- Attempt unauthorized access to any portal, account, or system;
- Upload or transmit malicious code;
- Use the Site to violate any law.

All trademarks, service marks, logos, copy, images, and other content are owned by Eki Mental Health PLLC or its licensors and are protected by U.S. copyright and trademark law. You may not reproduce, distribute, or create derivative works without written permission, except for fair use as permitted by law.

The Site may link to or embed third-party services (e.g., the Valant booking widget). Those services have their own terms and privacy practices, which you should review separately. We are not responsible for the content or conduct of third-party services.

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING (WITHOUT LIMITATION) WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EKI MENTAL HEALTH PLLC AND ITS PROVIDERS, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF YOUR USE OF THE SITE. OUR AGGREGATE LIABILITY ARISING FROM YOUR USE OF THE SITE IS LIMITED TO US$5,000.
Medical-malpractice carve-out. Nothing in these Terms limits your rights or remedies under applicable medical malpractice or healthcare-related laws (including Tex. Civ. Prac. & Rem. Code Chapter 74). Claims relating to clinical care are governed by the laws applicable to such care and are not subject to the liability caps or arbitration provisions in these Terms.
8. Indemnification
You agree to indemnify and hold harmless Eki Mental Health PLLC from any claims arising out of your misuse of the Site or violation of these Terms, except as limited by Section 7 above.
9. Termination
We may suspend or terminate your access to the Site at any time, for any reason, including violation of these Terms. Sections 4–8, 10, and 11 survive termination.
10. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute arising under these Terms (other than medical-malpractice claims, which are governed separately) shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts.
11. Changes
We may update these Terms from time to time. Material changes will be highlighted on the home page for 30 days. Continued use of the Site after changes become effective constitutes acceptance of the updated Terms.
12. Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy and any other notices on the Site, constitute the entire agreement between you and Eki Mental Health PLLC with respect to the Site.
